Court allows Western Infirmary Hospital to perform kidney transplantation surgeries

The Court of Appeal has issued an interim order suspending the directives given by the Director General of Health Services to temporarily suspend kidney transplantation surgeries at the Western Infirmary Hospital.

The committee appointed to look into the alleged kidney racket had earlier recommended temporarily suspending kidney transplantation surgeries at the Western Infirmary Hospital. Court of Appeal twojudge-bench comprising Justices Nissanka Bandula Karunaratne and M.A.R. Marikkar made this order pursuant to a writ petition filed by the founder and Chairman of Western Infirmary Hospital Prof. Rezvi Sheriff and Western Infirmary Hospital. The petitioners are seeking an order in the nature of a writ of Mandamus compelling the Director General of Health Services to permit the performance of the surgeries already approved at the hospital.

The petitioners stated that the entire incident, including kidney racket and the extortion of moneys were in pursuance of an orchestrated, manipulative media agenda.

President’s Counsel Faizer Musthapha with counsel Shaheeda Barrie, Hafeel Farisz and Ridmi Beneragama appeared for the petitioners.
